The Delhi High Court has taken note of a public interest litigation (PIL) alleging improper disposal of used swabs from COVID-19 Rapid Antigen testing kits. The court has asked the Aam Aadmi Party (AAP) government to provide information about the guidelines or protocols in place for the disposal of these testing kits and whether they are being followed by hospitals, clinics, and doctors under its jurisdiction.
The PIL was filed by lawyer Pankaj Mehta, who claimed that used swabs were being discarded in public and tests were being conducted over a pile of used swabs at the office of the District Magistrate (South East Delhi) in Lajpat Nagar. Mehta expressed concerns about the risk of widespread infection due to improper disposal practices.
In response, the Delhi government refuted the allegations, stating that the swabs being referred to in the plea were unused or defective. However, the court directed the government to provide instructions regarding the guidelines or protocols, including the authority that issued them, and whether they are being implemented.
The court also learned that the Delhi Pollution Control Committee (DPCC) has issued guidelines for the disposal of medical waste, according to the Delhi government counsels.
Mehta’s PIL highlighted the Clinical Management Protocol notification issued by the Union Health Ministry on July 3, which emphasizes safe waste management and environmental cleanliness in healthcare facilities. However, Mehta alleged that the Delhi government has failed to enforce these guidelines effectively.
The High Court has scheduled the next hearing for December 3, by which time the Delhi government is expected to provide the necessary instructions and information regarding the disposal guidelines.
