Trinamool Congress MP Mahua Moitra has moved the Supreme Court, alleging that the Nadia district administration evicted her from the Krishnanagar Circuit House despite her having been allotted a room at the state-owned property.
Moitra’s counsel mentioned the matter before a bench headed by Chief Justice of India Surya Kant. The lawyer sought an early listing of the petition and alleged that local officials acted despite a protective order from the Calcutta High Court. However, the Supreme Court did not grant an urgent listing of the matter.
The alleged incident dates back to the night of August 14, when Moitra was staying at the Circuit House in her constituency after the conclusion of a Parliament session.
Mahua Moitra Approaches Supreme Court
Moitra has approached the apex court through an Article 32 petition. Her counsel alleged that the district administration asked her to vacate the accommodation late at night.
The petition raised concerns about the alleged conduct of local officials and sought an independent investigation into the incident. Moitra’s lawyer told the court that the matter involved important constitutional issues and required an early hearing.
According to reports, Moitra alleged that officials evicted her from the Circuit House despite a protective High Court order. The Supreme Court, however, declined her request for an urgent listing at this stage.
What Happened at Krishnanagar Circuit House?
According to Moitra’s allegations, she reached the Krishnanagar Circuit House on August 14 and was allotted the room where she usually stayed during visits to her constituency.
She claimed that the staff had prepared the room and served her refreshments and dinner. Later that night, an official allegedly contacted her and asked her to vacate the premises.
Moitra said she received the request late at night and questioned why the administration had allowed her to check in if her stay was not permitted. She has alleged that the district authorities pressured her to leave despite her status as the sitting MP from Krishnanagar.
Allegations of Late-Night Eviction
Moitra alleged that the administration asked her to leave the Circuit House at around 11 pm.
Her lawyer told the Supreme Court that local officials had taken action in the middle of the night. The counsel argued that the alleged eviction required judicial scrutiny and an independent investigation.
The TMC leader has described the incident as harassment and claimed that it affected her ability to carry out her responsibilities in her constituency.
Moitra has also alleged that a crowd gathered outside the Circuit House during the incident and raised slogans.
Mahua Moitra Also Seeks Lok Sabha Speaker’s Intervention
Before approaching the Supreme Court, Moitra wrote to Lok Sabha Speaker Om Birla and sought his intervention in the matter.
She also submitted a privilege notice against senior officials of the Nadia district administration. In her complaint, Moitra alleged a breach of parliamentary protocol and accused officials of interfering with her ability to perform her duties as an elected representative.
The MP has maintained that the Circuit House served as official accommodation during her visits to the district headquarters.
She alleged that the administration did not inform her about any restriction when she booked the accommodation or when she arrived at the premises.
Supreme Court Declines Urgent Listing
When Moitra’s counsel mentioned the matter before the Supreme Court, the lawyer requested an early hearing.
The counsel argued that the case raised serious constitutional questions and required an independent investigation. However, the bench did not agree to urgently list the petition for hearing.
The matter could still come up before the court through the normal listing process.
The Supreme Court’s decision not to grant an urgent hearing does not amount to a ruling on the merits of Moitra’s allegations.
Political and Legal Attention on the Case
The controversy has drawn attention because it involves a sitting Member of Parliament, the district administration and questions surrounding official accommodation.
Moitra has alleged that the actions of the officials amounted to harassment and violated established protocol. The administration’s conduct and the circumstances surrounding the late-night order are now at the centre of the legal dispute.
