The Calcutta High Court has refused to grant interim relief to the Mamata Banerjee-led faction of the Trinamool Congress in its challenge to Ritabrata Banerjee’s appointment as the Leader of the Opposition in the West Bengal Assembly. The court has allowed Ritabrata to continue in the post for now while the legal dispute remains pending.

A division bench of the High Court directed a single bench to decide the main challenge within two months. Until then, the Speaker’s decision recognising Ritabrata as the Leader of the Opposition will remain operative.

The latest order gives a temporary advantage to the rebel TMC camp. However, it does not settle the larger dispute over who should hold the Opposition post. The court has kept the appointment under judicial review and described the current arrangement as provisional.

High Court Declines Interim Relief

The division bench considered a challenge filed by senior TMC MLA Sobhandeb Chattopadhyay, who is associated with the Mamata Banerjee camp. Chattopadhyay had challenged the Speaker’s decision to recognise Ritabrata Banerjee as the Leader of the Opposition.

The Mamata camp had sought interim relief while the broader petition remained pending. However, the division bench declined to disturb Ritabrata’s appointment at this stage.

The court instead sent the matter back to a single bench for detailed consideration. It directed the single bench to decide the issue within two months. This means the legal dispute will continue, but Ritabrata can function as LoP during the interim period.

Ritabrata to Continue as Leader of Opposition

The court’s decision means Ritabrata Banerjee will continue to serve as the Leader of the Opposition in the Bengal Assembly for the time being. His appointment will remain effective until the single bench takes a decision on the pending challenge.

The division bench has not given a final ruling on the legality of the Speaker’s decision. Instead, it has allowed the existing arrangement to continue so that the functioning of the Assembly does not face unnecessary disruption.

The court also clarified that Ritabrata’s appointment remains provisional. The single bench will now examine the issues raised in the petition and decide whether the Speaker followed the correct procedure while recognising him as LoP.

Dispute Began Over Speaker’s Decision

The controversy centres on the decision of West Bengal Assembly Speaker Rathindra Bose to recognise Ritabrata Banerjee as the Leader of the Opposition.

Mamata Banerjee’s camp had backed veteran TMC MLA Sobhandeb Chattopadhyay for the post. However, Ritabrata emerged as the leader of a rival group within the party and claimed support from a substantial number of TMC MLAs.

The rival camps then put forward competing claims over the Opposition leadership. The dispute eventually reached the Calcutta High Court, with Chattopadhyay questioning the Speaker’s decision.

The legal battle has since become part of a wider political struggle within the TMC. The court’s latest order has allowed Ritabrata’s camp to retain its position for now.

Mamata Camp Faces Another Setback

The latest ruling comes as another setback for the Mamata Banerjee-led faction in its attempt to challenge Ritabrata’s position. The camp had sought judicial intervention to prevent him from continuing as LoP.

The High Court, however, decided against granting immediate relief. By allowing the existing arrangement to continue, the court has given Ritabrata’s faction more time to operate from its current position.

The ruling does not mean that the Mamata camp has lost the case permanently. The main petition remains pending, and the single bench will examine the legal questions in detail.

Therefore, the present arrangement could still change after the single bench delivers its decision.

Court Seeks Decision Within Two Months

The division bench has given the single bench a two-month window to decide the pending petition. This timeline could bring greater clarity to the dispute relatively soon.

For the moment, however, the Speaker’s recognition of Ritabrata remains in force. The High Court has chosen to allow the arrangement to continue while the legal challenge moves forward.

Ritabrata Camp Gets Temporary Relief

For Ritabrata Banerjee and his supporters, the ruling provides temporary relief. They can continue to operate with him as the Leader of the Opposition for at least the next two months.

The decision also gives the rebel camp additional time to strengthen its political position. Ritabrata has previously claimed substantial support among TMC MLAs and has presented his faction as a separate political force.

However, the court’s order does not confirm the rebel camp’s wider political claims. It only allows Ritabrata to remain LoP while the specific legal dispute over his appointment continues.
